To the maximum extent permitted by applicable law, Davanji's aggregate liability arising out of or related to the services or these Terms will not exceed the amount the customer paid to Davanji during the twelve (12) months immediately preceding the event giving rise to the claim.
In no event will Davanji be liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profits damages, regardless of legal theory, even if advised of the possibility of such damages.
These limits do not apply to liability that cannot be limited by law, including gross negligence, willful misconduct, or fraud.
The pricing of our services reflects this allocation of risk. The customer accepts these limits as a basis of the bargain.
No claim may be brought more than one (1) year after the cause of action accrued, except where prohibited by law.
